Based on the views of Hindus in Bali, the application of ornaments in the form of Balinese traditional symbols should follow the rules of the prevailing tradition.The symbols are created to show the cosmology and philosophy based on the teachings of Hinduism as indigenous in Bali and function as a means of a sacred ritual. But in reality the designers in Bali often exploit the symbols by “mutilating” and applying them to undue places, motivated by a desire to create a (...) product or environment characterized by Balinese ethnicity. For example, Acintya relief, Karang Bhoma, Garuda Wisnu and others are applied as façade decorations for shops and banks, or they are created in the form of a statue to decorate crossroads, or used for decoration of the human body in the form of a tattoo and so forth. Seen from a semiotic approach, these actions can damage the structure of the meaning of symbols, because they bring about the interruption of the established relations of the signifier and signified and they form symbol fragments with unclear relations to meaning. Similarly, in today’s designs stamped with such decoration, they appear awkward and meaningless. From such behaviour, that practice creates styles such as pastiche, parody, kitsch, camp and so forth. Introduction to Sexology [Vvedenie v seksologiiu] by I. S. Kon has finally been published after having made the rounds of publishing houses for many years. This is the first Soviet publication devoted to a description and an analysis of the genesis, development, and state of a new branch of scientific knowledge about man-sexology-which affects every one of us. To be sure, General Sexual Pathology [Obshchaia seksopatologiia], a textbook for physicians edited by G. S. Vasil'chenko, which came out in 1977, (...) has an extensive introductory chapter on sexology, but it is limited to medical problems. Kon's book is an example of an interdisciplinary approach that provides an idea of the most essential components of sexology; it is thus addressed not only to the medical profession, but also to sociologists, philosophers of culture, psychologists, pedagogues, etc. The book takes into account the latest publications in this area of science. A great deal has been written in the past twenty-five years on the ways in which we perceive our environment and show our preferences for particular kinds of landscape. But most of this literature is based on consolidated data abstracted from questionnaires and we have almost no detailed case studies showing how habits of environmental perception and landscape taste have developed in single individuals. In this book Professor Jay Appleton, who has been closely involved with landscape aesthetics for twenty years, (...) attempts an autobiographical study of the evolution of his own habits of perception, and his own emotional responses to particular kinds of landscape. The book traces some of the ways in which attitudes and habits of thought, once established, have influenced, encouraged and constrained the theoretical ideas on landscape which Jay Appleton has developed in his earlier published work. Historical research has ~ecently made it dear that, prior to Austin and. his followers, there was but one author who developed a full-fledged theory of the given sort: the phenomenologist Adolf Reinach (1884-1917).' In his The A Priori I'oundutions of the Ciui/ I aIO, pubhshed. in 1918„' Reinach developed a theory of — 'as he termed them — "social acts*' which is not only on a par with the later speech act theories but in fact surpasses them in.

The Sciences of the Qurʾān contain information about the process of Qurʾān and its structural characteristics, language and stylistic features, as well as statistical data on the content of the Qurʾān. This information, which contributes significantly to the understanding of the Qurʾān, is generally classified within the relevant narratives and the classifications are sometimes associated with verses. In this context, the way in which the Sciences of the Qurʾān explain the verses, which do not act solely on methodical premises, differs (...) from the Qurʾānic exegesis books. In the Sciences of the Qurʾān, the subject of revelation forms are classified within the frame of the narrations, and the 51st verse of the Sūrat al-Shūrā is frequently referred to. In other words, the related classifications are matched with the 51st verse of the Sūrat al-Shūrā. In the exegesis, this verse is handled more comprehensively considering its context and the literal possibilities. There are two remarkable comments about this verse in terms of its reflection in the revelation classifications. However, on the contrary, it is possible to encounter examples where the verse is subject to specific discussions. One of them belongs to Jār Allāh al-Zamakhsharī (d.538/1144) and the other to Nāṣir al-Dīn al-Bayḍāwī (d. 685/1286). When the exegesis of al-Zamakhsharī and al-Bayḍāwī are examined, it is seen that this verse is the subject of ru’yat Allah (seeing Allah) discussion between Muʿtazila and Ahl al-Sunnah and the classifications are made in this context. However, it is interesting to note that the classification of al-Zamakhsharī is more suitable for the perspective of the Sciences of the Qurʾān. In this study, the codes of the determinations made by al-Zamakhsharī and al-Bayḍāwī related to the 51st verse of Sūrat al-Shūrā was read on the commentaries. While al-Zamakhsharī explains this verse as a proof for the argument that God cannot be seen, al-Bayḍāwī develops an example of reactionary interpretation upon Zamakhsharī’s view. The Sciences of the Qurʾān (as a discipline), which opens a separate title to the ways of revelation, uses this verse as a template and takes it away from the discussion. In the study, the subjective dimensions of the discussion and classifications made in the context of this verse were evaluated. As a result, it is concluded that a classification similar to classification of al-Zamakhsharī has been made in the literature of the Sciences of the Qurʾān as it provides more comprehensive framework. Summary: During the period of revelation of the Holy Qurʾān not only the sunnah and actions of the Prophet which explained the Holy Qurʾān, but also various sources of information based on language and consultation, were used in order to understand the Holy Qurʾān. The first people introduced to the revelation used their own language/oratory skills, which were natural them, to understand the Qurʾān and were also able to observe the events and problems that brought about the revelation of the verses. These elements, used by those first people for understanding the Qurʾān, were readily available in their society. Therefore, understanding of the Qurʾān while the Prophet was still alive did not require a codification of those resources or treatment of the matter on a theoretical level. Subsequent generations mostly compensated the lack of those advantages by the use of the Sciences of the Qurʾān books penned individually after 2nd Century (A.H.), and those written systematically under the collective name "the Sciences of the Qurʾān" starting from the 6th century (A.H.). These works covered many subjects such as the beginning of the revelation, the accentuation of the Qurʾān, the physical development process of the Qurʾānic text, information based on observation as well as the tone and content of the Qurʾān and provided information details for Qurʾānic interpretations. Over time, this information was classified in the Sciences of the Qurʾān literature, organized under various relevant titles and enhanced with examples, numerical and qualitative information. One of the main topics of the Sciences of the Qurʾān is the subject of “revelation and its forms”. In the literature of the Sciences of the Qurʾān, the classifications made under this topic are generally associated with the verse 51 of Sūrat al-Shūrā. In this verse, the forms of communication between Allah (Jalla Jalaluhu) and the servant/prophet are categorized. The context of the verse 51 of the Sūrat al-Shūrā in the tafsīr literature is different from the context in the Sciences of the Qurʾān literature. As a matter of fact, while this verse is examined in detail with respect to the context, concept analysis, and the possibilities of i‘rāb (classical Arabic grammar), it is merely referred to in the Sciences of the Qurʾān. This is due to the fact that the determinations and classifications made in the Sciences of the Qurʾān are shaped mostly in the light of the historical context and narrations of the subject.It is also possible to encounter examples of tafsīr where the 51st verse is made the topic of detailed discussions. There are two remarkable comments about this verse in terms of its reflection in the revelation classifications. One of them belongs to Jār Allāh al-Zamakhsharī (d.538/1144) and the other belongs to Nāṣir al-Dīn al-Bayḍāwī (d. 685/1286). The tafsīr s of al-Zamakhsharī and al-Bayḍāwī make it clear that this verse is the subject of ru’yat Allah discussion between the Muʿtazila and Ahl al-Sunnah and the classifications are made accordingly. The fact that i‘rāb examinations of the two authors are similar and both took into account other linguistic possibilities despite their preferences, which also prove that the points of conflict are not literal. Al-Zamakhsharī thinks that this verse determines the way Allah speaks not only with his prophets but also with all people. According to al-Zamakhsharī, the 51st verse refers to the three forms of communication that takes place between God and any of His servants. Allah communicates with His servants; a) through inspiration, inspiration to heart or through dreams, b) by making His words heard through certain channels, c) by sending one of his angels as a messenger. In the verse, the first is expressed as revelation, the second is to speak behind a veil, and the third is to send a messenger. According to al-Zamakhsharī, Allah's inspiration to the mother of Moses, the dream that He showed to Abraham regarding the sacrificing of his son and inspiration of Psalms to David, all relate to the revelation concept mentioned in the first option. Al-Zamakhsharī believes that revelation from behind a veil is an adage. This adage can be compared to a king speaking with one of those at his service behind a veil/curtain, where the person hears the voice of the king but cannot see him. Allah only spoke to Moses and angels in that manner, and sent angels to speak to His other servants/prophets.As a response to al-Zamakhsharī, al-Bayḍāwī interpreted the verse concisely explaining the 'revelation' (وحيا) as a secret word that is quickly understood. Because, in terms of its nature, revelation is not a word made up of sound waves that come one after another to make words. In the verse, this word refers both to the Night Journey (Mi‘rāj) and the talk mentioned in the hadiths regarding the ru’yat Allah, and Allah speaking to Moses without Moses seeing Allah. However, in the verse min verâi ḥicâb/attributed to the word 'revelation 'من وراء حجاب makes it clear that the expression refers to a form of speech in which Allah is heard but not seen. Therefore, the word 'revelation' refers to a mutual talk and according to al-Bayḍāwī, this is proof that ru’yat Allah is possible. The fact that the classifications made in the Sciences of the Qurʾān literature agrees with the classification of al-Zamakhsharī, not al-Bayḍāwī. This result is closely related to the structural features of the Sciences of the Qurʾān in which authors strive to make general explanations that are beyond sectarian preferences and views. Understanding the verse as a conversation between Allah and man, and not between Allah and His prophet, provides a more comprehensive classification in terms of the use of revelations (not only the use of the word revelation) in the Qurʾān. Thus, the address that was made to Abraham in his dream, the revelation of to Moses' mother, and inspiration to our holy Prophet and other people can be interpreted according to this verse. In addition, the ru’yat Allah debate was excluded from the subject in the classifications made in the Sciences of the Qurʾān and implication of the verse was limited to the talks made in a worldly manner. In his justifiedly famous paper, “Elusive Knowledge” (Australasian Journal of Philosophy, 74:4, 1996), David Lewis presents a contextualist account of knowledge, which, like other contextualist accounts, depicts sceptical claims as involving application of a higher standard of knowledge than is applied in everyday ascriptions of knowledge. On Lewis’ account, the sceptic’s denials and the everyday ascriptions are made in different contexts, which allows them both to be true. His account gives detailed specification of how contexts are to be determined. (...) My paper points out that this view is unattractive to the sceptic, since it makes scepticism, even if true, completely disconnected from and irrelevant to the rest of our cognitive discourse. After arguing that the sceptic’s own ascriptions of knowledge (made outside the philosophy seminar room) can be explained in non-contextualist ways, I expound and criticise Lewis’ analysis of knowledge, taking up in particular a central component of his account, the “Rule of Attention”. In the central part of the paper I argue that the reasons given for the inclusion of the rule are all inadequate, and also that there are positive reasons for rejecting it. The final section of the paper argues that the excision of the Rule of Attention removed would leave Lewis’ account subject to serious counter- examples. (shrink)

The scholars of Ahl as-Sunnah, who are united in the view that sin will not nullify faith and other good deeds, dissented from opinion on the status of the deeds of the person who converted to Islam after his apostasy, in the first Muslim period. In general, Ḥanafī/Māturīdīs argued that those deeds would be in vain with direct apostasy, while Shāfiʽī/Ash'arīs also stipulated death for this purpose, and claimed that a person's previous deeds would not be lost with apostasy alone. (...) Comprehensive interpretations on this issue have found a place for itself mostly in tafsir rather than disciplines such as kalam, fiqh and usûl. Here, while Ḥanafī/Māturīdīs grounds on verse 5/5 of the Surah al-Ma’idah, which only mentions that deeds will be in vain through apostasy; Shāfiʽī/Ash'arīs is based on verse 2/217 of Surah al-Baqarah, which connects this futility to death as apostasy. The parties made different inferences against each other over the relevant verses and gave various answers. The most fundamental point of disagreement among these was the question of whether the first verse, which is muṭlaq in terms of usūl, should be attributed to the second verse, which is in the position of muqayyad. While Ḥanafī/Māturīdīs objected to this process with the thought that the conditions for attributing muṭlaq to the muqayyad were not met in the relevant verses, Shāfiʽī/Ash'arīs, which took a more flexible stance on this issue, approved this attributing process within the framework of the conditions and accordingly reached their relevant views. When the parties evaluated the relevant verses, they made their explanations mostly in the explanation of the 2/217 verse of the Surah Baqarah, which is prior to the arrangement and is in the position of a muqayyad. Since Shāfiʽī/Ash'arī scholars are already based on the relevant verse, it is quite understandable that the place where they examine the subject is the interpretation of this divine word. Ḥanafī/Māturīdīs, on the other hand, examined the issue here in order to respond to the meaning attributed to the verse by Shāfiʽī/Ash'arīs. Shafi'i/Ash'aris based their judgments on one of the two verses, Surah Baqara, 2/217, as a requirement of attributing mutlaq to the muqayyad, and in fact, accepted a single verse as a criterion. On the other hand, Ḥanafī/Māturīdīs, made separate judgments from both of them, claiming that the conditions for attributing muṭlaq to the muqayyad, were not fulfilled in the two related verses. In this context, they concluded from the first verse that death as apostasy necessitates eternal disappointment, and from the second verse, apostasy absolutely wastes deeds. Here, the most typical result of the separation between the two sects emerges as to whether a person will repeat the pilgrimage, for example, he performed while he was a Muslim when he returns to Islam after apostasy. While the Shāfiʽī/Ash'arīs, who thought that deeds will be wasted only by death due to apostasy, did not consider it necessary to go on pilgrimage again, while Ḥanafī/Māturīdīs, who thought that deeds will be lost directly with apostasy even if death does not occur, held the person responsible for pilgrimage. In this study, it will be tried to explain the basic intellectual framework of the view advocated by the parties and the background of what kind of criticism they brought to their opponents. On World Philosophy Day, November 15, 2018, the Institute of Philosophy of the Russian Academy of Sciences organized the international conference on the Russian classic writer I.S. Turgenev. During the plenary and two breakout sessions, speeches were given by philosophers, cultural researchers, historians ofRussia,USA,Germany,Austria. The conference’s attitude to the consideration of the multifaceted heritage of the great Russian writer made it possible to highlight in the modern historical and cultural context many aspects of Turgenev’s work, to rethink stereotypes existing (...) among researchers and in the mass consciousness regarding Turgenev. At the conference, Turgenev was presented as a political thinker, a liberal who embodied spiritual asceticism, a supporter of the dialogue of cultures, a “Russian European” who does not accept “new barbarism” in all its manifestations from radicalism to Russian exclusivity idea. In the reports and speeches, attention was drawn to the cultural bilingualism inherent in Turgenev, his ability of non-biased artistic and philosophical observation, which enabled him to analyze the then state of minds in Russian society, to foresee many collisions inherent in the national historical process in the 20th – early 21st centuries and world cultural trends engendered by the “uprising of the masses,” to anticipate the drama of the absurd. At the conference, among the discussed topics were the themes of nihilism and loneliness, viewed through the prism of the existential experience of the writer and world literary characters. (shrink)

I discuss the behavior of the Akaike Information Criterion in the limit when the sample size grows. I show the falsity of the claim made recently by Stanley Mulaik in Philosophy of Science that AIC would not distinguish between saturated and other correct factor analytic models in this limit. I explain the meaning and demonstrate the validity of the familiar, more moderate criticism that AIC is not a consistent estimator of the number of parameters of the smallest correct model. (...) In response to globalization, is there to be a single, homogeneous set of aesthetic values governing the production and consumption of art? I focus on a newcomer to globalized contemporary art, China, and argue that artworld art is far from the only art currently being produced. I describe four connected kinds of art currently made in China: Modernist, traditional, and avant-garde, which are artworld art, and mass commercial, which is not. Practices in all four conform to expectations globally that (...) Chinese art of all kinds should exemplify imitation, emulation, and copying. Such conformity entails what Winnie Wong has termed ‘staging Chineseness’. I conclude with an examination of this process in two recent exhibitions before proposing that a proliferation of a variety of values is unavoidable while contemporary artworld practitioners continue to introduce local concerns, and while the self-claimed high status of artworld art is progressively challenged by the vitality worldwide of non-artworld art. While some of these values are resistant to Western globalizing homogenization, others conform to it. (shrink)

This paper is about pairing relation algebras as well as fork algebras and related subjects. In the 1991-92 fork algebra papers it was conjectured that fork algebras admit a strong representation theorem . Then, this conjecture was disproved in the following sense: a strong representation theorem for all abstract fork algebras was proved to be impossible in most set theories including the usual one as well as most non-well-founded set theories. Here we show that the above quoted conjecture can still (...) be made true by choosing an appropriate set theory as our foundation of mathematics. Namely, we show that there are non-well-founded set theories in which every abstract fork algebra is representable in the strong sense, i.e. it is isomorphic to a set relation algebra having a fork operation which is obtained with the help of the real pairing function. Further, these non-well-founded set theories are consistent if usual set theory is consistent. Finally, we will discuss related developments in propositional multi-modal logics of quantification and substitution, in algebraic logic e.g. cylindric algebras, the so called finitization problem, and applications to a logic introduced and studied in Tarski-Givant [42]. In particular, representable, weakly higher order cylindric algebras are finitely axiomatizable in a set theory which admits the axiom of foundation for finite sets. (shrink)

Imām Māturīdī, who is one of the symbolic names of Ahl as-Sunnah kalām and draws attention with his original ideas and striking determinations, revealed his views regarding kalām in his works called Kitāb al-tawhīd and Ta’wīlāt. Although the first one is in the field of kalām and the other is in the field of tafsīr, the second one has gained the identity of a work in which he declared many theological views. One of the theological issues in which his tafsīr (...) is the primary authority is the imamate and accordingly the companions. The Shīʿa’s making the imamate a part of the Islamic belief system and the takfı̄r of companions, who have a key role in this matter, paved the way for Ahl as-Sunnah theologians to put this issue on their agenda, so the issue has now become a matter of belief in its relevant dimension. The imagination of the companions, which took its place as a sub-topic of the imamate issue in the theological field, also entered the works of the theologians who expressed their views in this field, and a structure was formed that would respond to the perceptions of the Shīʿa, some other theological sects and some personalities that demean companions. Imām Māturīdī, who is undoubtedly one of the most important stones of Ahl as-Sunnah, also explained the subject with different dimensions and made statements that placed the companions in the position they deserved. Although Māturīdī did not reveal the concept of imamate and, accordingly, the companions in his theological work, he made some suggestions. He made important explanations on this issue in his tafsīr. The theologians, in their works in this field, highlighted the issues related to the companions, and whatever issues they touched on this matter, he often mentioned them in his tafsīr. Although there are partial differences in the subjects that Imām Māturı̄dı̄ concentrates on or comes into contact with due to the fact that he reveals his views mostly in his work of tafsīr rather than theology, the results he reached overlapped with the theologians. Imām Māturı̄dı̄ made explanations on the subject that can be grouped under headings such as the superior characteristics of the companions, the attitude to be developed towards them, the answer to the Shiite perception of the companions, the claims of conflict and struggles among the companions, and finally, evaluating them in accordance with their positions. Among these, the second title was mostly usūl-i fiqh, the last one was almost entirely tafsīr, while the others were subjects that were dealt with intensively in kalām. In this study, Imām Māturīdī’s vision of the companions will be revealed and what the companions mean in the mind and heart of an Islamic scholar who never neglected the mind and gave it great importance will be revealed. THE object of this note is to draw attention to a suggestion made by the late Professor F. M. Cornford, in the course of a paper read to the Oxford Philological Society some years ago.

This paper discusses the D-N model of scientific explanation. It is suggested that explanation is a part of assertive discourse where certain principles must be observed. Then use is made of the relation between the informative content and logical content of a sentence (as shown, for instance, by Popper) to draw some of the conditions necessary for a sound model. It is claimed that the conditions of the model proposed in the present paper exhaust the insights of the papers (...) in the literature, solve the difficulties encountered by other authors, but have some damaging consequences on the D-N model of scientific explanation. It becomes more obvious each year that the appeals of the party and government to strengthen the ties between philosophy and modern science are not being adequately implemented by the chairs of logic in the universities. In a number of institutions, a situation has persisted for a long time in which only a few professors and instructors deal with the subject area of dialectical and mathematical logic at a high professional level. Most of the teaching staff continue to conduct their (...) work essentially within the confines and at the level of the old, arbitrarily designated "traditional" formal logic, primarily in the form in which it took shape in the middle of the last century. It is clear that this does not accord with the demands of the party and of our philosophical and scientific public to raise the theoretical level of all instructional and research work in higher educational institutions. The erroneous orientation toward the old formal logic was, in particular, one of the reasons why the fundamental problems of dialectical logic have to this day not found unambiguous solutions. This is also one of the reasons why the science of logic has suffered some loss of authority among a portion of the country's students. It is not uncommon to see teachers who deal with dialectical logic giving inadequate consideration to the problems of contemporary natural and social science, while those who concern themselves with mathematical logic give inadequate attention to problems in the realm of philosophy. The appearance and persistence of this situation have made possible a sterile and erroneous approach to theoretical problems, the discussion of which is our present aim. (shrink)

An analogy between functional dependencies and implicational formulas of sentential logic has been discussed in the literature. We feel that a somewhat different connexion between dependency theory and sentential logic is suggested by the similarity between Armstrong's axioms for functional dependencies and Tarski's defining conditions for consequence relations, and we pursue aspects of this other analogy here for their theoretical interest. The analogy suggests, for example, a different semantic interpretation of consequence relations: instead of thinking ofB as a consequence of (...) a set of formulas {A1,...,A n} whenB is true on every assignment of truth-values on which eachA i is true, we can think of this relation as obtaining when every pair of truth-value assignments which give the same truth-values toA 1, the same truth-values toA 2,..., and the same truth-values toA n, also make the same assignment in respect ofB. We describe the former as the consequence relation inference-determined by the class of truth-value assignments (valuations) under consideration, and the latter as the consequence relation supervenience-determined by that class of assignments. The issue of wiping over socks is part of the more general issue of wiping over leather socks (khuffayn) for ablution (wuḍū’). Washing feet or wiping over them is a debate whose sides bases their claims on the verses of the Qur’an and supports these claims with narrations. When performing ablution, if shoes or socks are on the feet, whether one can wipe over them without taking these off and the qualities that these clothes should have is a debate based (...) on hadith narrations. Most Muslims except for the Ja’farite are of the opinion that either washing the feet or wiping over a khuff or similar clothing that was put on while a person already had ablution can be done during ablution, while the Ja’farite think that wiping over bare feet is enough but wiping over khuff is not. There is a consensus that shoes, boots, buskins and other leather footwear qualify as khuff. However, there is disagreement over whether clothing from materials like cotton, linen, wool, and felt -usually referred to as socks- qualify as khuff. For this reason, some Muslims of the world wipe over socks while others do not. There are contemporary fatwas (legal opinion) that are supportive of either of the positions. However, there are those who treat this issue beyond choosing a side in an ijtihad (process of juristic legal reasoning) and some who wipe on socks are censured strongly. In this research based on an examination of the fiqh heritage, the goal is to contribute to making this issue better understood and its fiqh ruling clearer.Summary: The sixth verse of Surah Ma’idah in the Qur’an clearly states that wuḍū’ requires washing the face, arms up until elbows, and wiping over the head. However, when it comes to the fourth element of wuḍū’, the feet, there has been disagreement about whether it should be wiped or washed. Arabic grammar rules and narrations have been interpreted in ways that support both views; in general Sunni sects, Zaydis, and Kharijites argue the feet should be washed while Shia Ja’farites are in favor of wiping over bare feet. There have also been efforts among faqihs (jurists) to reconcile washing and wiping; washing slightly; choosing the better one between the two; washing when not covered, wiping when covered; washing if there is dirt, wiping if it is clean; viewing at least wiping as fard (obligatory), washing as a Sunna (recommended) that includes the fard as a way to unify the two approaches have also been proposed.According to widely accepted narrations, the prophet and his companions washed their feet when performing wuḍū’ and once they put on their shoes having had wuḍū’, the next time they only wiped over the shoes without taking them off. In less commonly accepted narrations, which some hadith authorities regard as authentic, the Prophet is said to have wiped over his socks. In narration sources, it has been narrated that about fifteen faqih companions, among them ʿUmar b. al-Khaṭṭāb, ʿAlī b. Abī Ṭālib, ʿAbdallāh Ibn Masʿūd, ʿAbdallāh b. ʿAbbās, ʿAbdallāh b. ʿUmar, saw wiping over socks as appropriate. However, there are no narrations about the companions disapproving of wiping over socks. Among those who approved of wiping over socks are tābiʿūn (successors) faqihs like Saʿīd b. D̲j̲ubayr, Saʿīd b. al-Musayyab, Ibrāhīm al-Nakhaʿī, ʿAṭāʾ b. Abī Rabāḥ, al-Ḥasan al-Baṣrī ve al-Aʿmash, and Mujtahid Imams like Zufar, Sufyan al-Thawri, al-Ḥasan b. Ṣāliḥ, Ibn al-Mubārak, Abū Yūsuf, Muḥammad al-Shaybānī, Aḥmad b. Ḥanbal, Isḥāq b. Rāhawayh. Considering their most prominent positions, we can say that Ḥanafis and Shafis allow wiping over socks that are thick and opaque, Hanbalis allow it over socks that cover the foot even if thin, while Mālikīs do not allow wiping over socks at all.As far as it is understood from narrations from the Prophet’s time, due to both climate conditions and weaving possibilities, socks were used only rarely. Also, footwear like shoes or slippers made of leather were very hard to find and narrations suggest that prayers were performed at houses and the masjids over soil base on either bare foot or with shoes. For these reasons, the issue of wiping over socks did not arise at the time and at later periods different opinions on the issue led to disagreements. When carpets were placed on the ground at later periods, performing the prayer with shoes was abandoned and a second layer of shoes (khuff) was placed inside the shoes as khuff. Since removing the shoes would invalidate wuḍū’ performed over that shoe, those who wanted to avoid the difficulty of having to wash their feet each time they needed wuḍū’ have instead wiped over this second layer once they put them on after performing wuḍū’.Ḥanafīs and Shāfiʿīs, who tend to approach the issue of wiping over socks with hesitation and make this conditional on some strict rules, emphasize that the socks to be wiped over should be similar to shoes in terms of thickness, based on the idea that it is certain that the Prophet has wiped over shoes made of leather but his wiping over socks is weaker and that the qualities of those socks are not clear. Among the thickness criteria expressed for the socks are being waterproof, the ability to walk for at least a league with it, and its ability to hold on to feet without being tied at the wrists. Due to these criteria, which have been developed to protect the wuḍū’ and whose boundaries are not well specified, especially among Ḥanafis the idea that wiping over socks is not allowed has gained popularity. As opposed to this, in circles dominated by Ḥanbalīs opinions allowing wiping over any type of socks have been expressed.At times when the Prophet had his shoes on and did not want to take off his shoes, he used to wipe over the shoes. The equivalent of this act today is to wipe over socks since prayer with shoes on is not common any more. While nowadays wiping over socks is an ease for everybody when performing wuḍū’, it is something that is especially needed under certain circumstances. Cold weather and the lack of drying possibilities for the feet leading catching cold and illness, socks that are put on when feet are wet leading to bad smell and fungus on feet, the hardship of elevating the feet high enough to the sink and of changing socks on one foot when there are no special wuḍū’ places, the fact that at societies distant from Islamic culture it is seen against the etiquette to wash feet in the sink are among the reasons why this need arises. Because most of the time we are not in a position to determine the circumstances of our work and travels at modern times, it can be said that today this need is more than it was in the past.Some scholars of today use a precautionary principle and argue that the Qur’an commands to wash the feet, and the only narration powerful enough to make an exception to this rule is about masts made of leather, and extending this to include socks would go against the precaution principle and some other principles of uṣūl al-fiqh (Islamic legal theory). However, some other scholars who use the ease in religion principle argue that the permission to wipe over masts also include wiping over socks and that they are of the same nature, that there are authentic narrations that show wiping over socks are allowed and that one can even talk of an ijmāʿ (consensus) among the companions on this issue, and that seeking additional qualities socks on which one is to wipe over, such as thickness, ability to walk with it, its ability to hold on to the feet, being waterproof, have no merit in the sharīʿa. Jamaleddīn Qāsimī, who wrote a special research book on the topic, and scholars like Abū l-Aʿlā Mawdūdī, Yūsuf al-Qaradāwī, ʿAbd al-ʿAzīz b. Bāz, Ibn al Uthaymeen think that one can wipe over daily socks that do not show the skin beneath it, while scholars predominantly of the Ḥanafi opinion hold that one cannot wipe over the thin daily socks. The theme "Dostoevsky and Nietzsche" is one of the most important for understanding the meaning of the abrupt changes that took place in European philosophy and culture at the turn of the nineteenth century. This epoch is still a puzzle: it was a flourishing period for the creative powers of European humanity and at the same time the beginning of the tragic "breakdown" of history that gave birth to two world wars and unprecedented calamities, the consequences of which Europe has (...) been unable to overcome, as shown by the uninterrupted decline of traditional culture, which began at the end of World War II and still continues today. In this epoch, as in the eighteenth century, which culminated in the Great French Revolution, philosophy came out of the study onto the street and became a practical force that steadily undermines the existing order of things; in a certain sense it was precisely philosophy that called forth the catastrophic events of the first half of the twentieth century, which had as never before a metaphysical subtext. At the center of the upheaval that engulfed absolutely all forms of European civilization and culminated, at the beginning of the twentieth century, with the rise of nonclassical science, "nonclassical" art, and "nonclassical" philosophy, was the problem of man, his essence, the meaning of his existence, and the problem of man's relations with society, the world, and the Absolute. It is no coincidence that M. Scheler used the term "anthropological turn" to describe the changes that occurred in philosophy in this epoch; what had long been implicit in philosophy and art and in paradoxical fashion had become apparent even in the new scientific theories, was now made clear: man is not a tiny "atom" in boundless and alien being, but the starting point for all suppositions, the primary field of meanings from which any philosophical or scientific "questioning" must depart. The constantly accelerating progress of contemporary natural science is indissolubly associated with the development and use of mathematics and with the processes of mathematical modeling of the phenomena of nature. The essence of this diverse and highly fertile interaction of mathematics and natural science and the dialectics of this interaction can only be disclosed through analysis of the nature of theoretical notions in general. Today, above all in the ranks of materialistically minded researchers, it is generally accepted that theory possesses (...) a value of its own. Contrary to positivist concepts of the nature of our knowledge, the meaning and significance of theory do not consist merely of the recording of experimental data, their classification and notation in abbreviated form. The meaning of theory is considerably more significant and is revealed, above all, in its explanatory and predictive functions. Contemporary theoretical knowledge is quite advanced and comprises a highly complex system, relatively self-contained and capable of internal development. Mathematics is the most interesting and distinctive phenomenon in the system of theoretical knowledge, in the system of science in general. It is in its dialectical development that the internal force and dynamics of the development of theory, in the very broadest sense of that word, find expression. Paul Lafargue tells us that Karl Marx held that "science only attains perfection when it succeeds in making use of mathematics" . In many fields of research the formulation of new ideas and concepts rests upon mathematics, its concepts and notions, and "is suggested" by the latter. "Mathematics," writes F. Dyson, "is the main source of the notions and principles out of which new theories are created" . The basic significance of mathematics to theory has been noted by outstanding thinkers over the course of the entire history of development of science. Today the expressive phrase, "the mathematization of knowledge," has come into general currency as a description of the principal direction of growth of theoretical notions in natural science. However, with respect to the growth of modern theoretical physics in general, the statement that it develops primarily by the method of the mathematical hypothesis has general validity. For example, the principal findings and discoveries of quantum theory and particle physics, starting from the corpuscularwave dualism and terminating with the omega minus hyperon and hypothetical quarks, were obtained or made "at the tip of a mathematician's pen.". Herein lies one of the reasons for the constantly increasing attention to human freedom and to the intimately related problems of choice and decision-making.

Sezai Karakoç, who is a one of the most important poets and thinkers of the last period, developed an ideal by adapting the concept of resurrection in the creed to the resurrection in the world. His ideal of Seeing it as reviving the Sunnah of the Prophet Muhammad, Karakoç defined his cause as his cause. Prophet Muhammad, who has no direct relation to the knowledge of Hadith, but to the center of the world of thought. Karakoç, who put the Prophet (...) as a “measure” and “principle” or “blessed word” in some of his works, has made quotations that we can collect under headings such as the search for truth, the importance of knowledge, good morals, the battle with the soul, preparation for death and zuhd, without referring to anyone. The extent to which such transfers of uncertain affiliation take place in the hadith sources or to what extent they are related to hadiths has aroused our curiosity. We aimed to determine the place in hadith sources and their value in terms of hadith science, which Karakoç accepted as a "holy word" or as a rule and mentioned them in quotation marks without attributing them to anyone. Salafism is one of the most important issues of the last few centuries. There are intense discussions on the issues related to Salafism, its emergence, how it was first used by whom and in what sense. Discussions about Salafism are sometimes experienced in relation to whether this concept corresponds to a mentality or to a sect, and sometimes this phenomenon is brought up in relation to a number of important names that have taken place in the history of Islamic thought. (...) Ibn Taymiyya (d. 728/1328) emerges as the most frequently mentioned name in this context. Therefore, in this article, we have examined how Salafism/Salafiyya concept is used in the works of Ibn Taymiyya who is accepted as the theorist and the most powerful representative of Salafism. We have discussed the issue in a comprehensive manner by including the concept of Salaf, which is one of the most used concepts of Ibn Taymiyya. When we consider Ibn Taymiyya's use of the concepts of Salaf and Salafiyya, the concept of Salaf is seen to be used much more than the concept of Salafiyya. Thus, the concept of Salaf in the thought of Ibn Taymiyya refers to the Islamic society that lived in the early centuries and the conception of religion revealed by this society. The concept of Salafiyya, however, appears to have been used in a way that reflects a mentality and a way of thinking rather than a particular school or sect.Summary: Sects are human made structures that emerged with the institutionalization of differentiations in the conception of religion. The production of systematic theology and fiqh, the formation of its own literature, its dissemination and dissociation from other systems of thought are the most important turning points for the emergence of sects. One of the most important variables that determine the formation process of sects is the mentality of sect. It is known that the sects come into the realm of existence when the mindsets with the implicit reference system become visible. Therefore, there is a mentality on which every sect is based, but not every mentality has come to the point of being a sect. While some mentalities have influenced different sects in different shades, some of them have been confronted with only one sect.In fact, Salafism is one of the ways of thinking which is a mindset and it is a subject of important debates about whether it is a sect. Although the use of salafiyya is seen in the literature in the past, the fact that Salafism felt its existence as a kind of religion or mentality was realized in the 18th and 19th centuries. It is also known that the discussions about the definition of Salafism have started since these periods. From the second half of the 20th century, Salafism began to take a place in the agenda of both the Islamic world and the West. This has naturally led to efforts to define Salafism. Thus, Salafism is subjected to attempts to identify and associate with structures, such as denomination, ideology, religious understanding and mentality. In this direction, it is seen that Salafism is tried to be defined by establishing close link with the structures, such as Ahl al-Sunnah, Ahl-i Hadith, Hanbalism and Wahhabism or by reducing them directly to one of these structures. Thus, Salafism is sometimes backed up to the early stages of Islamic thought and sometimes associated with multilayered structures, such as the Ahl al-Sunnah, which embodies many political-mythic and fiqh structures.In line with the efforts of defining Salafism, it is also seen that many names that have had a say in classical Islamic thought or have been mentioned in modern times have been brought to the agenda. In addition to the names, such as Ahmad ibn Hanbal, Ibn Taymiyya, Ibn Qayyim al-Jawziyya, the names of Emir al-Saneyani, Muhammad ibn Abd al-Wahhab, Muhammad al-Shawkani, Shaykh Abdulaziz ibn Baz and Muhammad Nasir al-din al-Albani are frequently mentioned in this process. It should be noted that there is a special place of Ibn Taymiyya among these names. Ibn Taymiyya took the place of both in history of Islamic thought and Ahl al-Hadith-Hanbalite tradition and made a name for himself in the context of many subjects. It is claimed that Ibn Taymiyya, who was the theorist of the Hanbalite conception of religion, and the missionary of the New Hanbalism, was also the founding figure and the most important representative of Salafism. In modern times, most of those who declare ideas about Salafism place Ibn Taymiyya at the center of Salafism and present him as the founding name of this mentality. However, the question of what kind of relationship between the mentality called Salafism and Ibn Taymiyya's world of thought and religion is not the subject of academic studies. However, the works of Ibn Taymiyya, who is an author of a very velocity, should be analyzed from this point of view and all kinds of words about Ibn Taymiyya-Salafism relationship should be left behind this effort. Our study, which aims to fulfill this gap, was designed to explain topics, such as whether the concept of salafiyya was used in the works of Ibn Taymiyya, whether and how the past was used, and the extent to which the meaning attributed to the salafiyya coincided with the current Salafism. Understanding of the concept of the salafiyya in the works of Ibn Taymiyya depends on the explanation of how the term salaf was derived and used by Ibn Taymiyya. When the works of Ibn Taymiyya are scanned, it is seen that he used the word salaf much more than the word salafiyya. In fact, the word of salafiyya, which Ibn Taymiyya has rarely included, has been placed in some places in a way that refers to the meaning field of the word salaf. When we consider the use of the word salaf in the works of Ibn Taymiyya, we first see the generations who lived in the early historical periods of Islamic thought and the conception of religion which these generations have revealed. Other names that have taken place in the history of Islamic thought have similar opinions about the generation of the predecessors and the religious understanding of this generation. In other words, according to the general opinion of the predecessor, especially the first three centuries came to mind. However, it is seen that Ibn Taymiyya made some attempts to periodize both the generation of the predecessors and to define the understanding of religion of this generation. Nevertheless, Ibn Taymiyya could not provide a clear picture on this issue, and he occasionally contradicted his findings regarding his involvement in the predecessor generation. Nevertheless, he generally adopted generalizations and an attitude to limit the meaning of the predecessor to the first generations. The word salafiyya, which Ibn Taymiyya placed on the meaning of the word salaf, is used less compared to the word salaf and is given in more complete terms. This indicates that the main factor that influenced Ibn Taymiyya's salafi thought was salaf, not salafiyya as a systematic structure. These findings make it necessary to reconsider the claims of Salafism being a sect and it is being represented at the time of Ibn Taymiyya. (shrink)

International migration is increasing not only in absolute terms but also as a percentage of the global population. In 2019, international migrants made up 3.5 per cent of the global population, compared to 2.8 per cent in the year 2000. Over the past two decades, a philosophical literature has emerged to investigate what justice requires with respect to these vast migrant flows. My article criticizes much of this philosophical work. Building on the work of Charles Mills, I argue that (...) the terms in which many Anglo-American philosophers presently debate migration justice neglect and even obscure consideration of the ways in which current migration flows may be shaped by Euro-American colonialism and neo-colonialism. Such exclusions produce systematic biases in much of our philosophical literature. To develop less biased understandings of migration justice, I propose that Anglo-American philosophers should revise our methods and our conceptual frameworks to enable exploring the possible extent and ethical implications of colonial and neo-colonial influence. This is one part of the much larger task of decolonizing our political philosophy. (shrink)

Men Brayut is one of the interesting stories of Balinese people since ancient times until present that acts as a source of inspiration in art. This study aimed creating and describing the ceramic sculptures inspired by the Men Brayut story. This research uses qualitative descriptive approach in which the researcher becomes the main instrument. Data collection by observation and documentation. This statue was made using SP Gustami's creation method namely exploration, improvisation and embodiment. The results show that the creation (...) process of ceramic sculpture featuring Brayut image can be separated into two, they are the process of making the main character of Men Brayut and the process of making Brayut‟s children as an ornamental media that can show the image of Brayut on the sculpture. The creation this sculpture was started from the bottom using the combined technique of slab, pinching, and coil. Based on its function, the creation of this statue is functioned as the ornamentation and the practice as well as the ornamentation. This work implemented the green, blue and brown glazes with the combustion tempera-ture was 1200°C. Some of the created works were titled to Joy, Fatigue, Affection, and Affection 2. (shrink)

Tarski 1968 makes a move in the course of providing an account of ?definitionally equivalent? classes of algebras with a businesslike lack of fanfare and commentary, the significance of which may accordingly be lost on the casual reader. In ?1 we present this move as a response to a certain difficulty in the received account of what it is to define a function symbol (or ?operation symbol?). This difficulty, which presents itself as a minor technicality needing to be got around (...) especially for the case of symbols for zero-place functions (for ?distinguished elements?), has repercussions?not widely recognised?for the account of functional completeness in sentential logic. A similarly stark comment in Church 1956 reveals an appreciation of this difficulty, though not every subsequent author on the topic has taken the point. We fill out this side of the picture in ?2. The discussion of functional completeness in ?2 is supplemented by some remarks on what is involved in defining a connective, which have been included in an Appendix. The emphasis throughout is on conceptual clarification rather than on proving theorems, and the main body of the paper may be regarded as an elaboration on the remarks just mentioned by Tarski and Church. Suyolcu-zāde Nahrī Aḥmad (d.1182/1768-1769) was an important sûfî poet being a member of Ismā‘īl Rūmī branch, the sect of Qādiriyya. He carried out the duty of spiritual and ethical guidance at Qādiriyya Lodge in Tekirdağ. Besides his sûfî character, he was a poet having an extensive knowledge about the theoretical and aesthetical bases of Dīwān literature. The only original copy of Nahrī’s Dīwānçe including his poems registered in the Vatican Library, Turkish Manuscripts, nr. 235. There are forty-five Turkish, twelve Arabic (...) and three Persian poems by Nahrī in this copy. The goal of this article is to present the formal and contextual features of Nahrī’s poems in Dīwānçe in the light of the analysis on some poems that we chose. Any study was not found about the poet’s life and poems in the literature review we made. In this study, poems are classified according to the verse form and the language, and the number of couplets, type of prosody, form, style and content of the chosen poems are evaluated accordingly. This study has importance in terms of providing insight about the Religious-Sûfîstic belief in the region and period of Nahrī Aḥmad who was a sûfî poet and a member of Qādiriyya sect. In addition, the study gives information about many important influencers of the period, particularly Niyāzī-i Miṣrī and inform the readers about these influencers’ and sûfîs’ effects on Nahrī’s poems and ideas. The study also makes contribution to determining literary-sûfistic terminology of 18th century.Summary: Suyolcu-zâde Nahrī Aḥmad (d.1182/1768-1769) was a member of Qādiriyya Dervish Convent in Tekirdag where he was born. He became the head sheikh of this convent following his father Sheikh Muḥammad Efendi and worked for the convent in several ways. Nahrī Aḥmad moved back to his hometown in 1182/1768-1769 after completing his Hajj duty and died soon after that. Nahrī had two works according to Osmanlı Müellifleri (Ottoman Authors) and it is stated that the first one of these two works is about “unity of existence”. It should be mentioned that we haven’t found a copy of this work yet. The other work of Nahrī is his Dīwānçe, which includes his poems. The only copy of this significant work is registered in Vatican Library, Turkish Manuscripts, nr. 235. In this study, we had the chance to determine a third work of Nahrī which has never been mentioned in the related literature. This third work that we determined is based on the information in an Arabic poem on the page 21a of the poet’s Dīwānçe. This book that we determined is an interpretation book completed in 1166/1752-53 but Nahrī Aḥmad didn’t mention the name of the work. Nahrī Aḥmad was a spiritual guide and sufi, and he was assigned to the duty of showing the true path in dervish lodge following his madrassa education, learning Qādiriyya lodge’s morals and methods and completing his “spiritual journey”. Besides these, he was a significant poet who could write poems in Arabic, Persian and Turkish languages and he was literary competent who knew the theoretical and aesthetic rules of Dīwān literature and used these features professionally in his works. When Nahrī’s poems are analyzed, it can be seen that he adopted the understanding of existence, knowledge and belief based on Islamic Sufism. Besides, it can be seen that he internalized the significant Religious-Sufi Turkish literature figures including especially Yūnus Emre.In the copy of his Dīwānçe, registered in Vatican Library, there are forty-five Turkish, twelve Arabic and three Persian poems. There are two other poems that weren’t written by Nahrī in the same work. These poems were written by a poet with penname of ‘Ᾱrif in the period when Nahrī’s son Muḥammad Muṣlih al-Dīn was the head sheikh in the same Dervish convent. These historical poems are significant as they describe the re-building of ruined Tekirdag Qādiriyya convent after Nahrī’s period. The goal of this article is to present the formal and contextual features of poems in Nahrī’s Dīwānçe on the basis of chosen poems. As far as we could determine, there is no other study on Nahrī’s works. Nahrī’s Dīwānçe wasn’t a kind of rearranged work of collected poems. Therefore, we classified the poems in terms of the form and language and evaluated the number of couplets, aruz prosody, shape, type and content. Poems of Nahrī in Dīwānçe in terms of verse style are: Four Turkish, three Arabic, one Persian ode, one Turkish compounded stanza, seventeen Turkish, nine Arabic and one Persian major stanza, three Turkish five-line stanzas, two Turkish pentastichs, eighteen Turkish and one Persian lyric.Nahrī Aḥmad wrote five-line stanzas for three of Niyāzī-i Miṣrī’s lyrics and one of Bāqī’s lyrics. He wrote parallel poems about one pentastich, one lyric and one other poem written in a specific style of blank verse of Niyāzī-i Miṣrī. Besides, there is also an original poem that is quite unique in the work. Nahrī wrote five couplets before each verse in Niyāzī-i Miṣrī’s ode which resulted in the creation of a common ode. Poems in Dīwānçe are contextually religious-Sufi based. ‘Abd al-Qādir al-Jīlānī, Ismā‘īl Rūmī who was the founder of the order of Rūmiyya branch and other sheikhs of Qādiriyya dervish order are the main names mentioned in the poems. One other significant point in Nahrī’s poems is that he had a deep love and respect for Niyāzī-i Miṣrī. There are praises, quintets and parallel poems about Miṣrī in Dīwānçe which shows Niyāzī-i Miṣrī’s effect on his work. This effect is so great that it covered not only the content but also there are the signs of the effect in terms of metaphoric language, words and verses. It can be said that ‘Abd al-Qādir al-Jīlānī and Niyāzī-i Miṣrī, a member of Khalwatī order, were two significant names that surrounded the mental world of Nahrī, located in the texture of his poems and gave characteristic features to his works. There is a great number of historical poems in Nahrī’s Dīwānçe. He wrote twenty-six historical verses about various historical issues such as birth and death, construction of mosque, dervish monastery, zawiya, pavilion, repairing of mansion, renovation of dervish convent, enthronement of Sultan and appointment of Grand Vizier. Also, there are some other important parts in Nahrī’s Dīwānçe such as invocation, praise and self-adulation.Although there are not many poems in the previously mentioned copy in Vatican Library, there are various names mentioned in these poems. When these poems are analyzed, it can be seen that there are the names of some prophets, some companions of Prophet Muḥammad such as ‘Alī, Ja‘far al-Sādiq, some Persian legendary characters such as Afrāsiyāb, Rustem and Anūshirwān, some Sufi names such as Manṣūr al-Hallaj, Jalāl al-Dīn Rūmī, Shams al-Dīn of Tabrīz, Ḥācī Bektash Velī, Ibn al-‘Arabī and Bāyazīd al-Bisṭāmī, philosopher Galen and famous love heroes Laylā and Majnūn. That is to say, the poet has a rich world of references. On the other hand, there are the names of some works mentioned in Dīwānçe. Epistle of Niyāzī-i Miṣrī named Devre-i ‘Arshiyya, and Ibn al-‘Arabī’s al-Futūhāt al-Makkiyya are the other names mentioned in the work. Name of the places included in Nahrī’s poems are: Aden, Aqmescit, Baghdad, Baghcesaray, Baṭḥā, Balkh, Dimashq, Ḥijāz, Iraq, Iran, Cairo, Ken‘ān, Karbalā, Qılburun, Crimea, Kirmān, Egypt, Nemce, Rūm, Sanaa, Shām, Yemen. This study has importance in terms of providing insight about the religious-sûfî belief in the region and period of Nahrī Aḥmad who was a sûfî poet and a member of Qādiriyya sect. In addition, the study gives information about many important influencers of the period, particularly Niyāzī-i Miṣrī. Moreover, it informs the readers about these influencers’ and sûfîs’ effects on Nahrī’s poems and ideas. Sunnah is the second main source for Islamic law following the Qur’ān. Sunnah in the books on the Methodology of Islamic Law (Usūl al-fiqh) is examined in two main parts, one of which is as the source for religious commands and the other is being as religious/taklīfī commands. Sunnah is divided into three categories in terms of being the source for Islamic commands: qawlī (verbal), fi‘ilī (behavioral) and taqrīrī (approval). In the Islamic literature, when the word “sunnah” is mentioned, first (...) of all, it is understood as a verbal appeal, which is qawlī sunnah (hadith). Verbal sunnah has a rhetoric/wording that includes demand (amr/order-nahy/prohibition) or freedom (mubāḥ). And ultimately to the wording of this verbal address, some religious commands, such as farḍ/wājib, sunnah/mandūb, and permissible/mubāḥ are attributed. The behavioral sunnah (the acts of the Prophet Muḥammad), on the other hand, does not have a rhetoric that includes demand (amr/order-nahy/prohibition) or freedom (mubāḥ). The command/judgment is based on rhetoric. In other words, if there is an address, there is a command; if there is no address, there is no command/judgment. Therefore, it is problematic that the acts of the Prophet are decreed in the form of farḍ/ wājib, sun-nah/mandūb and mubāḥ. For this reason, the acts of the Prophet in the books on the Method-ology of Islamic Law (Usūl al-fiqh) have been particularly examined under the title of Afʿāl al-Rasūl. While some of the acts of the Prophet Muḥammad have a religious character, some of them are the acts that he performed completely in accordance with the customs and traditions in the society he lived in. Therefore, not all of the Prophet’s deeds/acts (behavioral sunnah) are at the same level in terms of obligation. Therefore, while some of the acts/deeds of the Prophet express wucūb, some other mandūb (sunnah-mustaḥab) and still some other ibāhā/mubāḥ. On the other hand, the acts of the Prophet Muḥammad, in terms of being the source of religious commands, are divided into two categories: the tashrīī (religiously) qualified and non tashrīī (religiously) qualified. What is meant by a religious act is the actions of the Prophet, which he performed as being a prophet, for the purpose of worshiping and that he wanted his followers act accordingly. What is meant by a non-religious act is the behavior of the Prophet as a human being or as a requirement of the society he lived in. Sunnah, in terms of being a religious com-mand, refers to commands other than fard and wājib. Ḥanafī scholars are of the opinion that sunnah as a religious decree is divided into two parts as sunnah-i hudā and sunnah-i zawāid. The acts of the Prophet, in accordance with his being a human or the custom of the society he lived in, are included in the scope of sunnah zawāid. In other words, sunnah zawāid generally means the actions of the Prophet that he did not do with the intention of worship. In this con-text, the acts of the Prophet Muḥammad are important. Because, the acts of the Prophet are not the same in terms of qualification (command), nor are they the same in terms of their nature (being religious or humanly natural). The acts of the Prophet Muḥammad with a religious nature are divided into two as known qualities and unknown qualifications. In principle, the religious acts of the Prophet, whose qualities are known, are also obligation for the ummah (Muslims). Therefore, when it is known for what purpose the Prophet Muḥammad made a deed/behavior, that act is accordingly is binding for the ummah (Muslims). Accordingly, if the attribute of a deed/behavior made by the Prophet is wājib/farḍ, it is also wājib for the ummah and permissible (ibāḥā) for the ummah if it is permissible. On the other hand, the acts of the Prophet in the Qur’ān as a mujmal (ambiguous nass /verse) are also subject to the command of mujmal. There is a dispute regarding the verdict of the Prophet’s acts of religious nature whose qualifications are unknown. According to the majority of Hanafī scholars, what is essential in the actions of the Prophet whose qualifications are unknown and that contain the characteris-tics of worship, is that it is mustahab/mandūb. According to Kerkhī (d. 340/952), what is es-sential in such deeds/behaviors is that it is permissible. Jassās (d.370 / 980) expresses the same opinion with Kerkhī. Opinions on this issue are conveyed from Imām Mālik and Imām Shafiī that he declared permissibility. The preferred opinion in Hanbalis is to declare permissibility. Non-religious acts of the Prophet Muḥammad as a human being or as per the custom of the society he lives in are not obligation for the ummah. Although the family is the safest environment for each member, sometimes violence and abuse can come from the family members. Violence causes family relationships to deteriorate as in all other relationships among people. Sibling violence, as a form of domestic violence, can sometimes have dire consequences that can result in family breakup, death or long-term loss of one of the siblings. In this study, sibling violence, which has the potential to harm family relations in such a way, will be discussed (...) in the context of two stories in the Qurʾān. It is aimed to contribute to other disciplines that study on this subject by examining the attitude of Islam against this violence, which affects the family, and the solutions of the Qur’ān to sibling violence. These stories in the Qur’ān are the story of Prophet Adam’s two sons who narrate an incident of violence that result in the brother killing his brother, and the story of Prophet Joseph and his brothers who narrate the sibling violence resulting in long-term loss. Both stories provide clues to the prevention of violence in the light of the causes of sibling violence and the behavior of the victim sibling in the development of events. In addition, because of the fact that these stories have taken place in the family of the prophets, they give people the message that sibling violence can happen in any family.Summary: Because of the social nature of the mankind, it must live in structured societies. Family is the medium for him where he is born, raised, socializes and prepares for his future life. It is normal sentiments of love, mercy and tolerance which dominate in a family. But despite this, it is possible for a family member to be a transgressor against another family member’s rights. Emotions like jealousy and hostility can cause violence between siblings. Psychologists generally attribute the source of this kind of violence to the parents’ failure to show equal love and affection to all children. While this is an important cause for violence among the siblings, craving for attention and acceptance from society, trying to achieve material and sensual superiority and desire for social success can incite feelings of envy among the siblings. While feelings of jealousy is unproblematic when its intensity can be considered normal, it can cause psychological imbalance if it increases to the level beyond manageable limits. If the latter case occurs, this produces a state of mind where a sibling becomes capable of committing every act of transgression to another sibling, which is the most important cause for the violence among siblings.Archetypical stories of Cain and Abel, and Prophet Joseph in the Qur’ān provide some clues pertaining to recognition and prevention of violence among the siblings. In these two parables, the real reason for envy does not lie in the other sibling. According to the Qur’ān, the true reason for this envy is attributed exclusively to the transgressor. In the parable of Cain and Abel, source of the problem between the siblings is the sacrificial offering to Allah. While the offering of Abel was accepted, Cain’s was not. Cain felt jealous and threatened his brother with death. Facing with his brother’s threat, Abel stayed firm and peaceful, said to his brother that if he were to attack him, he will not retaliate even for self-defence. He reminded Cain that his envy and anger was not due to him, Abel. Abel reminded Cain that the act that Cain was contemplating was a great sin in Allah’s eyes and that it is punishable by eternal hellfire. Cain, despite these warnings, went on to implement his intention of murder successfully.When we inspect the parable we can see that Abel was free from any guilt on his part for his brother’s envy which is the source of his transgression. His sacrifice was accepted because Abel was among the pious and this doesn’t harm or effect negatively Cain in anyway. Therefore the main cause for the jealousy of Cain is his unworthiness in the eyes of Allah, in reality, the reason is solely Cain himself. Therefore it is totally unfair when Cain put the blame on his brother Abel. By the way of this example, the Qur’ān reminds mankind not to blame others for his problems and to take responsibility. Envy, which is the main reason for violence among siblings, will cloud judgment and prevent clear thinking. In the parable of Cain and Abel, the Qur’ān recommends not to taunt the already jealous sibling by way of words and actions and instead, encourages warning against the grave consequences of evil intentions both in this world and in the hereafter. In the parable of Prophet Joseph, because of jealousy of their father from Joseph, bigger brothers of Joseph planned to kill him but they give up on the idea of killing him and instead they dumped him in a well. Later on in the parable, some merchant finds Joseph and brings him to Egypt. There, Joseph becomes a high ranking statesman and meets with his older brothers. Because of the famine, older brothers are in need of Joseph for food and asks him for it, without knowing that the person they are asking from is their little brother, Joseph. Although Joseph faces with his brothers on a superior position his behavior exemplifies the best course of action to end violence among the siblings. In order to remove animosity and callousness from his brothers’ heart, the gradual plan that Joseph had implemented is a great example for healing the wounds that violence among the siblings can cause. It is unreasonable to expect all the animosity and jealousy that brothers of Joseph held for years to go away completely in a moment. Prophet Joseph did not remind his brothers of their crime, on the contrary he was very generous to them. He brought their father and their brother Benjamin to Egypt and in front of them Prophet Joseph forgave his older brothers for the crimes they had committed against him. In this way, Prophet Joseph prevented his brothers potentially denying every transgression they did if he were to confront them in their first meeting, and made them ready to accept their evil deeds.Parables of Cain and Abel and Prophet Joseph are important for recognizing that envy can destroy the mercy that the siblings innately have for each other. It is understood from the parables that envy must be controlled and violence can’t be realized under any circumstances. It is clear from these parables that violence is never a solution for the jealousy among the siblings. A positive and viable solution would be for Cain to seek Allah’s approval instead of killing Abel and for brothers of Joseph this would be to earn their father’s love and respect. Introspection and analysis regarding possible reasons for jealousy and trying to resolve them and striving to be a better human, sibling, or child is a solution prescribed by the Qur’ān. Also, importance of speaking in a soft tone with the person who is experiencing intense jealousy, avoiding provocative language and behavior and trying every possible way to set this person straight is emphasized. The Qur’ān reminds us through these two parables that the human nature is prone to evil suggestions from the satan and for this reason humans need generous and benevolent help from others in order to clear themselves from these evil temptations. Polygyny, the marriage of a man with more than one woman at the same time is a well-known practiced in human history. Islamic law accepts the institution of polygyny as a substitute provision if it fulfills the certain conditions and reasons, -and limited the maximum number of wives to four. Although polygyny is mubah (permissible) in Islamic law, it is not an absolute right that every man can use arbitrarily. Thus in Islamic law, the legitimacy of polygyny has been attributed (...) to the presence of two basic conditions: the observance of justice among co-wives and providing maintnance. However, the observance of these conditions that is left to the mercy of men leads to the exploitation of the right for practicing to polygyny and victimization of the first spouse. Therefore, inserting some restrictions for using this right has come to the agenda from time to time in Islamic legal history. The first legal arrangements concerning the restriction of the polygyny (taaddud al-zawjāt) in the history of Islamic law were indirectly made with the Family Law Decree of 1917 which was prepared in the last periods of the Ottoman Empire. Among the late Islamic jurists, the issue of the limitation of polygyny by public authority in Islamic law continues to be discussed. The civil laws of contemporary Muslim countries contain different regulations on the issue. In this article, the restriction of polygyny by the public authority in Islamic family law will be focused on.Summary: Polygyny, the marriage of a man with more than one woman at the same time is a well-known practiced in human history. Thus, relevant verses in the Qur’an (al-Nisa 4/3, 129) and the Prophet’s own practice (al-Ahzab 33/50, 51, 59 al-Tahrim 66 / 3-5) show that it is legitimate for a man to marry more than one woman (up to four) at the same time in Islamic law. Although polygyny is legally permissible (mubah) in Islamic law it is not an absolute right that every man can arbitrarily use. Thus in Islamic law, the legitimacy of polygyny has been attributed to the presence of two basic conditions: the observance of justice among co-wives and providing maintenance. On the other hand, there may be some exceptional circumstances permitting polygyny in Islamic law. For example, when female population is much more than male in the society and when a, woman is can not fulfill her family duties due to her cureless illness, polygyny is permitted in Islamic law.As it can be understood from the explanations above, polygyny in Islamic law is not a general and mandatory provision that should be applied by every man who has legal capacity to marry. On the contrary, it is an exceptional provision that is justified if there are certain conditions and justifications. According to this; polygyny is a moral and legal institution that is made up of mutual consent based on individual and social conditions and needs in Islamic law. Therefore, men do not have to marry a second woman on their current wives, as well as women have the right to say “no” to marry a married man as a second wife.When the conditions and rationales indicated in the relevant verses and doctrine are evaluated together, it can be said that in order to be able to legitimize the polygyny in Islamic law, there must be three basic conditions:(1) Observing justice among spouses, (2) Having sufficient financial power to provide maintenance for spouses, (3) Existence of individual or social need or necessity.Therefore, in order to prevent the exploitation of polygyny, which is justified under certain conditions and justifications in Islamic law, the above-mentioned conditions must be fulfilled. Otherwise, polygyny can cause some problems, unrest and injustice for individual, family and society. Hence, in the presence of certain conditions and justifications, polygyny accepted in Islamic law as a moral and legal institution aiming the elimination of individual and social arbitration.Although the legitimacy of polygyny in Islamic law depends on the existence of certain conditions and special circumstances, it is a known fact that they are not always observed in practice. It can be said that the right of polygyny is a subject of abuse in practice. Therefore, the limitation of polygyny by the public authority has come to the fore in Islamic legal history. Today, control of the public authority and inserting some restrictions of polygyny continue to be discussed among the Islamic jurists. In the past, it is possible to say that the control of the exercising of this right has been done relatively by society (social environment). However, nowadays, since the society cannot perform the control mechanism, it is brought up by the state (public authority) on behalf of the society.Among the contemporary Islamic jurists regarding the supervision or limitation of polygyny by the public authority; there are two approaches: “those who accept” and “those who do not accept” such restrictions.Islamic jurists, who accept that public authority is allowed to intervene in polygyny, grounded their views on two perspectives: The first is that the polygyny is legally permissible and the public authority has the authority to limit the permissible (mubah) in Islamic law. The second is that polygyny is restricted with the conditions in the Qur’anic verses such as “husband’s observation supervision of justice among his wives” and “having the power for ensuring the livelihood (nafaqa) of his wives” and it is more appropriate for the benefit of society and the purpose of the legislator (Shari’) to be subject to the control of the public authority whether these conditions are present or not. Islamic jurists, who do not agree that the public authority has the right to intervene in polygyny grounded their views on two perspectives as well: First, polygyny is a legitimate right mentioned in the verses in Islamic law and there is no definite proof that this can be prohibited or restricted by the public authority. Secondly, it is contrary to the verses to prohibit or limit the right that the Qur’an makes legitimate (free).Thus, it is possible to say that the opinion which accepts that the public authority has to limit polygyny is more accurate in terms today’s social conditions. Namely, polygyny is linked to two basic conditions: ”husband’s observance of justice among his wives and having the power to provide maintenance for his wives. Therefore, supervision of the public authority on checking the existence of these conditions is more appropriate for the purpose of the legislator (Shari legitimizing polygyny and social benefit.In fact, the Ottoman Family Law Decree of 1917 indirectly limited the right of the husband to marry more than one woman, giving the woman right to stipulate a condition in her marriage contract that her husband not to marry a second woman. In the 1924 Draft of Family Law Decree, which was prepared after the repeal of the Family Law Decree of 1917, but not enacted, it was proposed that the application of polygyny should be presented to the approval judge.In today’-s Muslim countries, there are three different practices: namely “completely prohibiting polygyny”, ”releasing polygyny” and “giving the court the right to monitor the existence of necessary conditions “. In countries such as Morocco, Algeria, Iraq, Syria, Indonesia, Malaysia (and Pakistan), the validity of polygyny depends on the permission and supervision of the judiciary. Some of these countries which have accepted judicial review have given the judicial control for the requirement of justice, some of them the conditions of justice and maintenance some of them for the conditions of justice, maintenance and a legitimate justification.In sum, in accordance with the provisions of the relevant verses, polygyny in Islamic law is legitimately permissible (mubah). However, the public authority has the right and authority to limit the mubah in Islamic law in the case of the elimination of damage and the necessity of the public interest. On the other hand, the public authority has the right and authority to enact the law in Islamic law by preferring one of the existing ijtihads that meet the needs of the society and conforms to the conditions of the age.According to this, when the public authority made a statutory regulation that links the use of right of polygyny to the permission of the judge, this regulation is binding on society.Therefore, in the event of such a legal arrangement, it is possible for the public authority to allow the men who comply with the conditions and not to allow the ones who are not to comply with the conditions after conducting the necessary investigation. As a matter of fact, now Family Laws of many Muslim countries now include such legal arrangements. It is also worth mentioning here that there may be a necessity for a man to marry more than one woman (up to four) at the same time in terms of social benefits, when the population of male and female in a society is excessively disproportionate. In such circumstances, it is also possible that the public authority encourages, or even mandates, the marriage of men who have fulfilled the conditions to more than one woman. (shrink)

This research aims, first of all, to establish that Abû Hanîfa's (d. 150/767) positive view on the issue of performing wudû’ with nabîdh of date is correct, and then to reveal Abû Hanîfa's dalîls on this subject. The issue of wudû’ with nabîdh of date is controversial among early Hanafî jurists, and the jurist who expressed a positive opinion on this issue is Abû Hanîfa, the founding imam of the madhhab. The opinion that wudû’ can be performed with nabîdh of (...) date is the strong opinion of Abû Hanîfa mentioned in zâhir al-riwâya. The riwâya reported by Nûh bin Abi Maryam (d. 173/789) stating that Abû Hanîfa reneged on this view is not strong enough to oppose the view in zâhir al-riwâya. For this reason, it is not a correct approach to ignore the view in zâhir al-riwâya based on this riwâya. As a matter of fact, Abû Hanîfa's view of zâhir al-riwâya is conveyed in many of the classical Hanafî texts such as Mukhtasar al-Karkhi and Mukhtasar al-Tahâwî. Although the majority of Hanafî jurists preferred the view of Abû Yûsuf (d. 182/798), a significant group of Hanafî jurists such as Jassâs (d. 370/981), Kâshânî (d. 587/1191) and ‘Aynî (d. 855/1451) He supports Abû Hanîfa's view. Therefore, there are two views on the issue in Hanafî fıqh. In the literature, the dalîls of Abû Hanîfa's view is not available as a whole in a single source, but is scattered in many Hanafî fiqh sources. The Hanafî jurist Jassâs is the one who deals with the mentioned dalîls in the most comprehensive way in his many works. For this reason, the subject was examined by focusing on Jassâs's dalîls. Jassâs' istidlâls regarding the issue of wudû’ with nabîdh of date also mean defending Abû Hanîfa against other Hanafî jurists such as Abu Yusuf and Imâm Muhammad (d. 189/805). Jassâs' insistent attitude on this issue and his passionate counter-answers prove how much he deserves the title of defense. For the relevant determination, Hanafî fiqh classics are centered. Because the jurists who argue that wudû’ can be made with the nabîdh of date are among the Hanafî jurists. Then, the positive and negative approaches of the jurists about the nabîdh of date are given. Starting from the early Hanafî jurists, the views of the sahâbîs, the tâbi'ûn and many later jurists on the subject are included. The approach of the four madhhabs of fiqh is also examined in this section. Then, the istidlâls of Jassâs, which is the main subject of the research, were emphasized. It is seen that Jassâs' istidlâls have three main pillars: âya, hadîth and idjma. As a âya, the 6th âya of the sûra of Mâida, as a hadîth, the hadîth of ‘Abd Allâh bin Mas'ûd (r.a.) and as a idjma, the the sahâbîs idjma tries to showas references. The most controversial dalîl is undoubtedly the hadiths of Ibn Mas'ud (r.a.). Jassâs opposes those who claim that the hadîth is da‘îf and discusses the hadîth with its detailed tarîks and argues that this hadîth is sahîh. (shrink)

The tradition of Western philosophy has been tracing out the significations of logos and centered around logos. This in fact has given birth to many significant results. Through its logical structuring of empirical reality it has made possible critical understanding transcending the past and progressive creation of the future. But this Logology or Logocentrism has eventually also led to its self-destruction and to the brink of absolute nihilism.Along the history, logos has been interpreted in various ways. The history implies (...) that at least in the cosmic, theological and ideological frameworks logos used to be seen as extralinguistic substance; whereas starting from the scientific mode of thinking logos has been seen more as intralinguistic substance . This ends up in the political perspective in which logos is without substance: mere effects of the play of texts and discourse.While the latter appears like a predicament, the fact is that it can also be taken as a moment of liberation, a liberation from the keen yet stifling Western paradigm of logos apophanticos which has animated all kinds of “positivistic” mode of thinking; a liberation from the so-called Metaphysics of Presence, hence an openness towards the Absence, the ambiguity, the indefinability or the elusiveness of reality ; an openness towards the richness and complexity of human experience; hence an openness for mutual interogative and transformative dialogues among different semiotic systems, traditions and language games, which would also empower and incorporate non-Western as well as non-scientific mode of thinking into global discourse.Perhaps wisdom lies in the courage to recognize the fact that ultimately reality or the so-called Being is not a substance, but rather, fleeting relations, ever-changing networks, or elusive flux. Wisdom ultimately might mean an ability to come to terms with insecurity, an ability to see through the “absence”. (shrink)

More nationalist than humanist and less rationalist than populist, Pericles' vision for Athens (...) rested on the establishment of an Athenian reputation for military success and the citizens' willingness to sacrifice in the service of this goal. Despite his own aristocratic ancestry, Pericles offered the common and collective Athenian people the kind of fame previously available only to heroes and nobleman, a goal made all the more attractive because of the Athenians' defensiveness about Athens' lackluster early history. Introduction. A radical tendency in modern approaches to understanding the mechanisms of the brain is the tendency of some scientists to believe that the brain is a receptor capable of capturing thoughts; the nature of the occurrence of the thoughts themselves, however, is not to be clarified. However, speech expressing thoughts is undoubtedly the result of the work of the brain, so studies of the frequency structure of speech can be the basis for considering the material structure of the brain (...) as a kind of “antenna”. In this approach, the problem of noise protection against the background of the undeniable frequency similarity of speech and music appears to us from somewhat different positions. This study raises the question of how essential the overall height of the musical system is to the perception of music (are there musical systems that are harmful or useful, in terms of their effects on the psyche). This question is also relevant to speech perception.Methodology and sources. The main sources in which the work of the brain and the essence of consciousness are considered from the positions indicated above were for us the work of American and British neurophysiologists and psychiatrists (Sam Parnia, Peter Fenwick). These scientists are studying the phenomena that accompany clinical death, and argue that at these moments the brain functions to the greatest extent as a receiving “antenna”. Assuming that any antenna is to be tuned, we are trying to identify possible ways to “tune” the brain. To do this, we propose to study the frequency characteristics of speech (in the simplest case, when singing vowels in a calm state) for their belonging to a particular musical system, as well as the peculiarities of music perception depending on the musical system (on the height of the note “la”). Varying the frequency characteristics of speech in a particular musical system can be considered, in our opinion, the main way to “tune” the brain. The methodology of the method is based on the use of frequency analysis of sound and the basic provisions of the elementary theory of music.Results and discussion. The main conclusion made by Western psychiatrists is the brain is not an organ of thought, consciousness exists independently from outside, the work of consciousness cannot be explained by the functioning of the brain – it requires a hardware check. If the neural network is an “antenna” that captures thoughts, and its “adjustment” at the physical level can be carried out (and is carried out) through sensory systems (including the hearing organ), the study of the frequency structure of speech will answer a number of important questions, including including related and higher brain functions (insight, creativity). Our experiments (Saint Petersburg Electrotechnical University, FIBS, department of EUT) showed that the influence of the “increased” or “lowered” musical-speech system on brain activity is insignificant. The study revealed the equiprobability of the frequency structure of speech. Since our brain lacks some characteristic set of frequencies – elements of a uniformly temperamental system, it is not necessary to talk about the harmful (or any other noise) effect of the “raised” and “lowered” systems due to deviation from the “internal standard”.Conclusion. In response to the assumptions made by Western experts, we proposed a frequency interpretation of the processes occurring in the brain, which, perhaps, will explain in more detail such phenomena as inspiration, discovery, etc., which occur with minimal activity of consciousness. Despite the limited methods of hardware study of factors that influence the activity of the brain and largely determine its higher functions (for example, creativity), the results of the brain's work in relation to music (both in terms of its creation and in terms of our reaction to it) are quite analyzable, which was shown in this study. The “musicality” of speech is extremely vividly represented in its frequency structure and allows one to reveal, to one degree or another, the features of the brain. (shrink)

We argue for an example of based on Diamond and Carey's (1986) work on expertise and recognition, which is not made use of in The Origin of Concepts. This mechanism for perceptual learning seems to have all the necessary characteristics in that it is innate, domain-specific (requires stimulus sets possessing a certain structure), and demonstrably affects categorisation in a way that strongly suggests it will influence concept formation as well.

I discuss the behavior of the Akaike Information Criterion in the limit when the sample size grows. I show the falsity of the claim made recently by Stanley Mulaik in Philosophy of Science that AIC would not distinguish between saturated and other correct factor analytic models in this limit. I explain the meaning and demonstrate the validity of the familiar, more moderate criticism that AIC is not a consistent estimator of the number of parameters of the smallest correct model. (...) Since Edmund L. Gettier reminded us recently of a certain important inadequacy of the traditional analysis of "S knows that p," several attempts have been made to correct that analysis. In this paper I shall offer still another analysis (or a sketch of an analysis) of "S knows that p," one which will avert Gettier's problem. My concern will be with knowledge of empirical propositions only, since I think that the traditional analysis is adequate for knowledge of nonempirical truths.
